Appeals Court Order Lets Ohio Require Hemp Approval, Bars Geographic Denials

Follow-up reporting on the Sixth Circuit's partial stay of the Senate Bill 56 injunction says Ohio may enforce its approval requirement but cannot deny companies based on where they are located.

Key Facts

OHIO, October 6, 2026: A federal appeals court order that partly paused an injunction against Ohio's Senate Bill 56 lets the state enforce the law's approval requirement for hemp sellers but keeps in place a bar on denying companies based on where they are located, according to reporting that detailed the order's scope.

The Sixth Circuit allowed Ohio to enforce portions of the law that do not depend on where a company or its products are located, while preserving the block on geographic restrictions on where products are sourced, manufactured or distributed, The Marijuana Herald reported September 29. A Homegrown Group policy brief dated September 28 said hemp companies can no longer sell in Ohio without approval from the state's marijuana regulator, but that Ohio cannot deny that approval because of where a company is based. The case is *Titan Logistics Group LLC v. Tischler* (No. 26-3648). The Herald named plaintiffs including Titan Logistics Group, Saucy Seltzer, Appalachian Girls, The Hemp Collect and Mellow Fellow.

The brief said the order applies to the ten plaintiffs in that case and that companies in the separate *Delta Beverages Inc. et al. v. Canepa* case keep their own September 4 injunction, though Ohio is expected to cite the appeals ruling against it. It counted fourteen Delta plaintiffs; earlier reporting named ten. It dated the order "Friday, September 27," a Sunday; other reporting places it on Friday, September 25.

Missouri's federal judge has not ruled on the state's motion to dismiss the House Bill 2641 lawsuit, and the Seventh Circuit has not acted on Wisconsin's vape directory appeal.
