Three pending legal challenges anchoring the Midwest's hemp beverage landscape, Ohio's SB 56 litigation, Missouri's HB 2641 lawsuit and Wisconsin's vape directory appeal, saw no rulings this week.
MIDWEST, September 15, 2026: The Midwest's three pending hemp beverage legal fights, in Ohio, Missouri and Wisconsin, remain unresolved as courts weigh cases that have drawn no rulings in more than a week.
In Ohio, the Sixth Circuit Court of Appeals has not ruled on the state's bid to overturn a preliminary injunction shielding ten hemp companies from Senate Bill 56's restrictions, and a separate federal injunction won September 4 by a second group of plaintiffs, including Fifty West Brewing, Great Lakes Brewing and Rhinegeist, in *Delta Beverages Inc. et al. v. Canepa et al.* also stands unchallenged so far. In Missouri, a federal judge has not ruled on the state's motion to dismiss a hemp industry lawsuit over House Bill 2641, which bans most intoxicating hemp products but carves out an exception for beverages tied to the federal government's own deadline, now December 11. In Wisconsin, the Seventh Circuit has not acted on Wisconsinites for Alternatives to Smoking and Tobacco's September 5 notice of appeal seeking to block the state's hemp-inclusive vape product directory law.
Elsewhere in the region, no state advanced new hemp beverage legislation, rulemaking or enforcement action, and no regional brand or distributor reported a notable business development this week.
