A Travis County judge will hear a request to block the state's trace-amount THC standard, while the Fifteenth Court of Appeals has yet to set argument in the separate hemp rules appeal.
GULF & INTERIOR SOUTH, October 22, 2026: A Travis County district judge is set to hear a request on October 30 to temporarily block the Texas Department of State Health Services' "trace amount" standard for hemp products, in a lawsuit brought by distributors and retailers represented by attorney David Sergi.
Judge Maria Cantu Hexsel of the 53rd District Court will preside over the 9 a.m. hearing. A different judge denied the plaintiffs' request for a temporary restraining order on September 6.
Separately, the Fifteenth Court of Appeals has not scheduled oral argument in Texas Hemp Business Council v. DSHS, according to the council's case tracker. Both sides have requested argument, and the court may instead decide the appeal on the written briefs, which closed September 17. The department's March 31 total-THC rules remain enforceable while the appeal is pending.
